Bayer Combination Aspirin Class Action Settlement

Bayer has reached a $15 million class action lawsuit settlement regarding certain combination aspirin products that were sold without FDA approval and were allegedly falsely advertised. If you purchased Bayer Women’s Low-Dose Aspirin or Bayer Aspirin with Heart Health Advantage, you may be entitled to receive compensation from the Bayer aspirin class action settlement, even if you do not have proof of purchase.

The Bayer aspirin settlement will resolve a class action lawsuit, called In re: Bayer Corp. Combination Aspirin Products Marketing & Sales Practices Litigation, that accuses Bayer of violating state consumer fraud and deceptive business practices acts, express and implied warranty statutes, and unjust enrichment laws in connection with the sale and marketing of Bayer Women’s Low-Dose Aspirin plus Calcium and Bayer Aspirin with Heart Advantage.

Plaintiffs in the Bayer combination aspirin class action lawsuit claim these products should not have been sold, because these products were not FDA-approved, could not provide all advertised health benefits and were inappropriate for long-term use. As a result of Bayer’s alleged conduct, consumers were overcharged for the combination aspirin products, the class action lawsuit asserts.

Bayer denies any wrongdoing, but has agreed to a $15 million class action lawsuit settlement to resolve the litigation.

Class Members of the Bayer combination aspirin class action settlement include U.S. consumers who purchased one or more of the following combination aspirin products for personal, family or household use during the follow time period:

Bayer Aspirin with Heart Advantage Settlement Class
Purchase Date: January 1, 2008 to July 20, 2012

Bayer Women’s Low-Dose Aspirin plus Calcium Settlement Class
Purchase Date: January 1, 2000 to July 20, 2012

Class Members who do not have proof of purchase can submit a Claim Form to receive a one-time payment of $4 for all purchases of Bayer Women’s and/or $6 for all purchases of Bayer Heart Advantage, subject to pro rata reductions if the claims for payment exceed the settlement fund.

Class Members with proof of purchase can submit a Claim Form to receive $4 for each purchase of Bayer Women’s and/or $6 for each purchase of Bayer Heart Advantage, subject to pro rata deductions.

Claim Forms must be postmarked or submitted online by April 29, 2013 in order to receive money from the Bayer aspirin settlement.
