Can You Do Anything If State Farm Delays Your Claim?

The wildfires ripping through Los Angeles in January 2025 were unprecedented. The fires kept burning, and residents could not think of anything else but to take their loved ones and pets and flee.

As a result of these devastating fires, State Farm has already paid out nearly $500 million in insurance claims. This equals more than 10,000 claims for home and vehicle damage. This comes as the combined losses for the Palisades and Eaton fires have been projected to be as high as $35 billion.

It was only announced on January 31 that both fires had been 100% contained. Many residents have not returned home yet, and more claims are forthcoming.

If you have a claim to submit, whether wildfire-related or not, now is the time to do it. Even so, you may be in for quite a wait as State Farm works through the stream of claims it receives.

It is also important to remember that while it seems as though State Farm is paying out claims left and right, you may experience a delay with yours (as will others).

State Farm is a for-profit business, so they will still look for ways not to pay your claim. As horrible as that sounds, it is a business first and will always try to protect its bottom line as a matter of priority.

If you experience a delay in settling your wildfire claim, there are steps you can take to resolve the situation. But, it is also crucial to understand why your claim may be delayed and when to take action.

Wildfire Claim Delays

There are several reasons why State Farm may delay your claim. The most common ones include:

The damages can also be widespread because they affect structures, foundations, and personal property. All of the damaged components must be evaluated properly to calculate a settlement.

  • Investigation requirements. Insurers typically have to conduct investigations, including on-site. They would also have to review and assess fire reports to determine the extent of the damage. This is all done to validate and process your claim.

  • High claim volume. There is also a huge claim volume, as there usually is after a natural disaster. State Farm is experiencing a huge surge in claim filings, which can lead to a longer processing time for your claim.

  • Missing documents or information. It is also possible for the delay to be traced back to your application. You may have neglected to complete some of the sections of the paperwork. You may also not have provided all the necessary information.

Keep these factors in mind so you can adjust your expectations if necessary. They will also guide you into taking action if your wildfire claim is unnecessarily delayed.

California Regulations on Wildfire Insurance Claims

The insurance industry in California is regulated by the California Department of Insurance (CDI). The CDI sets all the standards on how claims must be handled. CDI regulations are meant to protect policyholders when they file a claim.

Some of the most important points of the CDI process include:

  • Prompt investigation. California law dictates that insurers must investigate all claims quickly and fairly. At the same time, there is no set timeline for wildfire claims. Still, insurers like State Farm must act within reason and not drag out claims too long.

  • Good faith. Insurers are also compelled to act in good faith when managing claims. This means they must process your claim fairly and not use underhanded tactics to minimize your settlement.

  • Consumer protection. If you believe your claim is being handled incorrectly or unfairly, you can get help from the CDI. The department will investigate your complaint and advise you on the next steps.

What to Do If Your Wildfire Claim Is Delayed

Losing a home in a wildfire is frightening, horrifying, and emotionally taxing. Like everyone else affected, you likely just want to start rebuilding and move on, but you cannot do this if your claim keeps getting delayed.

If you find that your claim has stalled, here are some steps you can take:

  • Review your policy. Read through your entire insurance policy and look for sections related to wildfire claims. Here, you should find information on your client rights and State Farm’s obligations. Knowing the fine print on your policy can help you establish whether your claim delay is justified.

  • Contact the claims adjuster. Contact the relevant claims adjuster if you cannot find the information you need in your policy. Ask them about the reasons for the delay and when you can expect your claim to be resolved.

Remember to make notes of all your communications with the adjuster and other parties working for State Farm. This documentation may be important later on. This means saving emails and writing down dates and times when speaking to them on the phone.

  • Provide all the necessary information. As a rule, claimants must provide extensive documentation when filing a wildfire claim. This means you must include repair estimates, detailed inventories of damaged items, and photos of the destruction to your home.

If you provide all the right information from the start, it can help move along your claim.

  • Follow up. You should not just submit your claim and wait for a payment. You must follow up as soon as a reasonable period has elapsed. Phone State Farm or send emails. Be persistent so they can see you are serious about resolving your claim.

Seeking Legal Advice

If you are not getting anywhere to resolve a claim delay, you should consider consulting a lawyer.

A lawyer is your best bet if your wildfire claim has been delayed for several weeks to months without explanation. You will also need a lawyer if State Farm is unresponsive or if you believe they are not complying with California insurance laws.

Do not wait until the delay causes you financial hardship. Instead, hire a lawyer sooner rather than later.

It is crucial not to be passive about your claim. Escalate the issue and work with your lawyer to get your claim paid. This will allow you to start looking forward and moving on with your life.
